A collision over the weekend in East Austin has led to a slew of felony charges against a driver, some arising from the accident itself, and two others resulting from its aftermath.

Police say that when they arrived near the intersection of Manor Road a Pecan Brook Drive, they found two vehicles in the roadway. A damaged Honda sedan was blocking both northbound lanes of one of the streets. About ten yards away, they found a Ford pickup truck, also damaged. The pickup was empty, but the driver of the Honda had facial injuries, and did not appear to be breathing. It turned out she was in fact dead. A passenger in the Honda, who was injured in the collision, told police that the pickup ran a red light and struck the Honda.

So what about the driver of the Ford truck? Here is what allegedly happened. After the accident, the driver fled, or at least attempted to do so, when he was confronted by a witness who had followed and tried to detain him. The two exchanged blows. The driver had apparently requested that he be picked up by a friend, and when the friend arrived, he left the scene. The “getaway car” was eventually stopped by police, and the driver of the Ford was arrested. The officers say that the driver exhibited slurred speech, had bloodshot eyes, and failed field sobriety tests.

The list of charges against the driver is impressive, and includes the following, in addition to any charge of DWI:

  • Manslaughter (second degree felony);
  • Intoxication manslaughter (generally a second degree felony);
  • Failure to stop and render aid (a third degree felony because of the death);
  • Intoxication assault (generally a third degree felony); and
  • Aggravated assault (here, a second degree felony).

The items on the list are all serious crimes. And an interesting aspect of these charges is that even if the prosecution is unable to prove intoxication, then the manslaughter, leaving the scene, and aggravated assault charges will nevertheless remain. However the case progresses, we’d say the driver has an uphill fight on his hands.
